Parents Sue Doctor Over Birth Injury

The parents of a baby girl are suing after their daughter suffered a brain injury during the birth process at Memorial Hospital. They believe that a doctor is to blame for their daughter’s cerebral palsy.

The parents filed a lawsuit on December 28th in St. Clair County Circuit Court against the Protestant Memorial Medical Center, doing business as Memorial Hospital and the doctor that attended the birth of their daughter.

The parents claim that their daughter was born with a hypoxic brain injury. This injury means that she did not receive enough oxygen to her brain during the delivery. As a result, their daughter developed cerebral palsy. This disease caused her to lose her enjoyment of a normal life, sustain disfigurement, disability, and pain and suffering, stated the New York Birth Injury Lawyer. Along with her injury, their daughter is no longer able to become adequately educated, will not be able to earn as much later in life, and will have continued medical costs her entire life. Cases like this are constantly dealt with by lawyers in Brooklyn and The Bronx.

The parents blame the doctor who administered to them at Memorial Hospital for causing their daughter’s injuries. A New York Birth Injury Lawyer discovered in reports provided by the parents that the doctor negligently ruptured the mother’s membranes, and then failed to utilize in-utero resuscitation maneuvers, or to prepare for an immediate C-section when their daughter had a period of prolonged deceleration. They are seeking a judgment of more than $150,000 plus court costs.
