Non-profit Consumer Advocacy group pushes to update the Toxic Substances Control Act of 1976

NY Birth Injury Lawyers have been examining the work of a non-profit’s group to pass what they call the “Kids-safe Chemical Act,” which hopes to be a major upgrade to the original Toxic Substances Control Act of 1976.

“Basically this group says there is a strong link between pollution and diseases in our population including lung cancer, infertility and birth defects,” said on NY Birth Injury Lawyer. “Current law does not force chemical companies to prove a chemical is safe before it ends up in children’s toys and products.”

He went on to explain that the Toxic Substances Control Act has not been amended since 1976 and has been recently called the weakest of all major environmental laws on the books today.

When TSCA passed, it declared safe nearly 62,000 chemicals, which were already on the market and provided no data to support this policy. Since then more than 19,000 more chemicals have been added into the United States, also with little or no data to support their safety, which to this environmental group puts our human race in a very polluted situation.

“These groups are concerned that babies are born pre-polluted with as many as 300 industrial chemicals in their bodies. They have identified 455 chemicals in people, and again, there is no data about whether or not these exposures are safe,” said the NY Birth Injury Lawyer.

The Kid-Safe Chemical Act hopes to change this problem and force testing on the dangers of these chemicals. The use of these products can lead to fatal birth injuries and in Staten Island and Westchester County hospitals know this.

“Under our current laws, the EPA cannot demand to evaluate the risks of these chemicals,” said a NY Birth Injury Lawyer. “The Kid-Safe Chemical Act will force manufacturers to prove the safety of the current 62,000 approved chemicals and to require all chemicals to be approved for safety for people of all ages.” He added.

The information obtained from this act will also be required to become public knowledge.
