Abuse Ruled Out in Infant Brain Bleeding

In Washington D.C., a neurosurgeon testified in an infant abuse case, stating that the bleeding on the brain of a 6-week-old infant was probably not the result of abuse at all, sources told New York Birth Injury Lawyers. In fact, it is his assertion that the problem may have occurred due to birth trauma.

The doctor showed that 2009 medical records from the child show signs the little boy had blood in a part of his brain that was too deep to be the result of abuse. The doctor also said the blood was likely a recurring injury that happened during a difficult birth process when the fibers of the brain were torn.

“It verified to me that this is a birth-related injury,” the neurosurgeon said. These lawyers such as those in The Bronx and Brooklyn must be aware of the damage which brain injuries can do to a newborn.

The neurosurgeon also expressed disbelief that the brain injuries were caused by abuse. According to him, there was “no evidence of any kind of mechanical trauma.”

Testimony has been finished in the child endangerment trial. The father of the boy has been charged with six felonies, many of which do not relate to brain injury, including a broken arm, the infant spitting up blood, and even ceasing to breathe on July 8, 2009.

Prosecutors say the father was taking care of the baby when each of these incidents occurred.

Witnesses for the prosecution serving in a medical expert capacity have already told the jury that the child suffered a severe brain-stem injury which actually caused his heart to stop beating temporarily, which stopped the flow of oxygen to the brain, causing permanent brain damage.

The defense had an explanation for the child’s broken ribs, as well, claiming CPR was the most likely cause for those injuries.

The neurologist had no comment about the other injuries, but he maintains the baby was not shaken at all, because of the lack of a spinal injury. An adult shaking a child hard enough to cause brain damage would also cause damage to the neck, and the neurosurgeon could find no sign of that.

The case is set to close soon, which will leave everything in the hands of the jury.
